New Source Review Bill Redefines 'Pollution Increases' for Factories and Power Plants

If you live near an industrial plant or work in one, the rules of the game for upgrades are about to change. The New Source Review Permitting Improvement Act aims to tweak the Clean Air Act to make it easier for facilities like power plants and factories to modernize. Currently, if a plant makes a change that increases its emissions, it usually triggers a rigorous (and expensive) permitting process. This bill changes the yardstick for what counts as an 'increase.' Under Section 2, a change only counts as a modification if the maximum hourly emission rate—the absolute peak of what it can pump out in sixty minutes—is higher than anything it achieved in the last 10 years. Section 2 specifies that a project isn't a 'modification' if it’s designed to improve reliability, safety, or efficiency per unit of production. In the industrial world, if a factory becomes more reliable, it stays online longer.
