The Artificial Intelligence Data Center Moratorium Act hits the emergency brake on the physical backbone of the AI boom. Effective immediately upon signing, the bill bans the construction or upgrading of any "Artificial Intelligence Data Center"—defined as facilities using over 20 megawatts of power with specialized high-density cooling or server racks. This isn't just a temporary pause; it’s a full-stop freeze that lasts until Congress passes a separate, massive wave of regulations. For the tech industry, this means multi-billion dollar projects like Mark Zuckerberg’s Manhattan-sized data center in Louisiana could be stuck in legal limbo indefinitely. To get the moratorium lifted, Congress must pass laws that guarantee AI won’t threaten "the future of humanity" or the "privacy and civil rights" of working families (Section 3(b)(1)). Even if those laws pass, any new data center would face a gauntlet of five strict requirements: they cannot raise your monthly electric bill, they must have zero negative impact on the environment, and local communities must be given the power to vote the projects down.
